Estahad & Co. LLC (“the Company,” “we,” “our,” or “us”) provides digital marketing, automation, and business support services to clients globally. By using our website and purchasing our services, you agree to these Terms of Service (“Terms”).

 

2. Acceptance of Terms

By accessing our website, scheduling a consultation, or purchasing a service package, you (“Client,” “Customer,” or “you”) confirm that you:

  • Have read and understood these Terms.

  • Are legally capable of entering into a binding agreement.

  • Agree to comply with them fully.

If you do not agree, please discontinue use of our website and services immediately.

 

3. Services Overview

Estahad & Co. LLC delivers two primary categories of services:

  1. Growth Systems — including lead generation, automation, funnel optimization, CRM setup, and content systems.

  2. Business Support Partners — including AI-assisted virtual assistance, executive operations management, and strategic analytics.

We also provide custom and project-based services under written agreements. Each service or plan is defined in a written scope, invoice, or subscription summary.

 

4. Service Delivery & Communication

  • Communication occurs primarily via email, video meetings, or project dashboards.

  • Clients must provide all necessary materials (branding assets, credentials, etc.) for timely delivery.

  • Estahad & Co. LLC provides regular updates and deliverables as defined in the service plan.

  • Delays caused by client unresponsiveness do not extend the service term or qualify for a refund.

 

5. Payment & Billing

  • All payments are processed in USD via Stripe or other authorized platforms.

  • Payment is due in advance of each billing period or milestone.

  • Late or failed payments may lead to suspension or termination of services.

  • Recurring charges will continue until canceled under our Refund & Cancellation Policy.

  • Invoices are automatically generated and emailed after each payment.

 

6. Client Responsibilities

You agree to:

  • Provide accurate and up-to-date business information.

  • Maintain secure passwords and account credentials.

  • Not share confidential materials publicly without consent.

  • Comply with all applicable local and international laws.

 

7. Intellectual Property Rights

  • All custom deliverables, creative assets, or code become the client’s property upon full payment.

  • Estahad & Co. LLC retains the right to display non-confidential work in portfolios or case studies.

  • Internal tools, templates, and training materials remain proprietary and are not transferred.

 

8. Confidentiality

Both parties agree to maintain the confidentiality of sensitive business information. Confidential data will not be disclosed to third parties except:

  • As required by law or authority.

  • To authorized subcontractors under similar confidentiality obligations.

 

9. Subcontracting & Partnerships

Estahad & Co. LLC may subcontract tasks to vetted specialists or partner agencies but remains fully responsible for quality and delivery.

 

10. Service Modifications

We may modify, suspend, or discontinue any service or pricing plan with prior notice to active clients.
Changes will not retroactively affect existing paid contracts unless mutually agreed.

 

11. Cancellation, Refunds & Pauses

All refund, cancellation, and pause terms are governed by our Refund & Cancellation Policy.
By purchasing any service, you acknowledge that you have read and agreed to that policy.

 

12. Disclaimers

While Estahad & Co. LLC strives for measurable results, we do not guarantee specific financial outcomes or client acquisition results.
All services are provided “as-is” and “as-available.”

We are not liable for third-party tools or vendors (e.g., Meta, Google, Zoom, CRMs) used during service.

 

13. Limitation of Liability

To the maximum extent permitted by law:

  • Estahad & Co. LLC and its affiliates are not liable for indirect, incidental, or consequential damages.

  • Total liability for any claim shall not exceed the total fees paid by the Client in the last 90 days of service.

 

14. Indemnification

You agree to indemnify and hold harmless Estahad & Co. LLC, its officers, employees, and partners from any claims, damages, or expenses resulting from misuse of services or breach of these Terms.

 

15. Data Protection & Privacy

We comply with GDPR, CCPA, and other applicable privacy regulations.
We collect only necessary data and never sell client data.
Refer to our Privacy Policy for details on data retention, cookies, and compliance.

 

16. Termination of Service

We reserve the right to suspend or terminate services if you:

  • Fail to pay after repeated reminders.

  • Engage in fraudulent, abusive, or illegal activities.

  • Breach these Terms or signed agreements.

Clients may terminate services anytime under our Refund Policy with written notice.

 

17. Dispute Resolution

  • We aim to resolve all disputes through communication and mediation.

  • If unresolved, disputes will be governed by the laws of the State of New Mexico, USA, and handled in New Mexico courts.

  • Clients agree not to initiate chargebacks before contacting billing@estahadandco.com for resolution.

 

18. Force Majeure

Neither party is liable for delays or failure in performance caused by events beyond control (natural disasters, regulatory actions, internet outages, etc.).

 

19. Amendments

We may update these Terms periodically. Updates will appear on our website with a “Last updated” date.
Continued use of our services implies acceptance of the revised Terms.
